Lane Garrison, the Prison Break star threatened with real-life jail time after he plead guilty to vehicular manslaughter, has been spared from being sentenced to hard time... at least for the time being.

Gossip website TMZ reports that shortly after Garrison took to the stand on August 2, Beverly Hills Superior Court Judge Elden S Fox remanded the actor for a diagnostic, meaning he'll be sent to a California prison for 90 days while psychiatrists determine whether he's a suitable candidate for parole.

TMZ added that Fox may let Garrison go free after he's served the three months in jail. The district attorney protested again the diagnostic, arguing that Garrison should serve four years in prison.

Fox's verdict came not long after Garrison testified about the events of December 6, 2006, when he crashed his Land Rover into a tree and killed his 17-year-old male passenger Vahagn Setian. Beverly Hills police later revealed his blood alcohol level was .2 per cent and that he had cocaine in his system at the time of crash.

Garrison will be sentenced on October 31, and faces up to six years in prison.

If they think at the end of the 90 days he's suitable for parole, then he goes free. And there is a good chance that, that will happen. He got a good deal, seeing how Paris went to Prison for 21 days and nobody died.
